Terms of Service

These Terms of Service govern your use of the courier and logistics services provided by DAK Logistics Ltd ("we", "us", "our", or the "Company"). By booking a delivery, creating an account, or using our website and services, you agree to be bound by these terms. If you do not agree, please do not use our services.
DAK Logistics Ltd is a company registered in England & Wales. Our services are available to individuals and businesses within the United Kingdom only.
1. Definitions
- "Services" means the courier, delivery, and logistics services we offer via our website, app, or telephone booking.
- "Consignment" means any parcel, package, document, or item submitted to us for delivery.
- "Sender" means the person or entity that books the Service and hands the Consignment to us.
- "Recipient" means the person or entity named as the receiver of the Consignment.
- "Prohibited Items" means goods we do not carry, as set out in Section 6 below.
2. Eligibility and Account Registration
- You must be at least 18 years old to use our Services. By booking, you confirm you meet this requirement.
- Business account holders must provide accurate company information, including registered address and contact details.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- We reserve the right to suspend or terminate accounts where fraudulent, abusive, or unlawful activity is suspected.
3. Booking, Payments, and Cancellations
- All bookings must be made through our website, mobile app, or by telephone. Verbal instructions given to drivers do not constitute a valid booking.
- Prices quoted at booking are fixed unless the Consignment details materially change (e.g., weight, dimensions, or destination).
- Payment is due in full at the time of booking unless you hold a pre-approved business credit account.
- Cancellations made more than 24 hours before the scheduled collection are eligible for a full refund. Cancellations within 24 hours may incur a charge up to 50% of the booking fee. No refund is available once collection has been attempted or completed.
- We accept major debit and credit cards, bank transfer (for business accounts), and approved digital payment methods.
4. Collection and Delivery Obligations
- The Sender must ensure the Consignment is securely packaged, correctly addressed, and ready for collection at the agreed time and location.
- Attempted collections where no one is available, or the Consignment is not ready, may be treated as a failed collection and charged accordingly.
- Delivery timeframes (e.g., same-day, next-day) are estimates and not guaranteed, except where you have purchased a guaranteed timed service. Standard services are subject to traffic, weather, and operational conditions.
- If delivery cannot be completed due to an incorrect address, refusal by the Recipient, or failure to provide access, we will attempt redelivery once at no extra charge. Further attempts may incur additional fees.
- We may leave a Consignment with a neighbour or in a safe place only where the Sender has explicitly authorised this at booking.
5. Your Responsibilities as Sender
- You warrant that all information provided at booking is accurate and complete, including weight, dimensions, value, and address details.
- You must ensure the Consignment is packaged adequately for transport. We accept no liability for damage caused by insufficient packaging.
- You must not submit Prohibited Items (see Section 6). If you do, you are fully liable for any loss, damage, fines, or penalties incurred.
- You agree to indemnify us against any claims, losses, or costs arising from your breach of these Terms.
6. Prohibited and Restricted Items
The following items are strictly prohibited from carriage:
- Illegal goods, counterfeit items, or goods infringing intellectual property rights
- Firearms, weapons, ammunition, explosives, or fireworks
- Hazardous materials including flammable liquids, gases, corrosives, and toxic substances
- Human or animal remains, organs, or ashes
- Live animals (unless pre-arranged via our specialist live-animal service)
- Cash, currency, bearer bonds, negotiable instruments, and precious stones or metals over £5,000 in value
- Perishable goods requiring temperature-controlled transport (unless booked under our temperature-controlled service)
- Aerosols exceeding 150ml, perfumes exceeding 500ml, and alcoholic beverages exceeding 70% ABV or 5 litres volume
Restricted items (e.g., lithium batteries, magnetic materials, and pharmaceuticals) may be carried subject to prior written approval and compliance with applicable regulations.
7. Liability and Insurance
- Our standard liability for loss or damage is limited to £100 per Consignment unless you declare a higher value and pay the applicable premium.
- Maximum declared value is £10,000 per Consignment. Items exceeding this value must be agreed in writing before collection.
- We are not liable for indirect or consequential losses (e.g., loss of profits, missed deadlines, or reputational damage) arising from delay, loss, or damage to a Consignment.
- We are not liable for loss or damage caused by: (a) inadequate packaging by the Sender; (b) inherent defect or perishable nature of the goods; (c) acts of terrorism, war, or civil unrest; (d) seizure by customs or regulatory authorities.
- Claims must be submitted in writing within 14 days of the scheduled delivery date, including photographs, receipts, and proof of value.
- We aim to resolve valid claims within 30 days of receiving all required documentation.
8. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events outside our reasonable control, including but not limited to: severe weather, flooding, road closures, strikes, industrial action, pandemics, government restrictions, fuel shortages, or vehicle breakdown. In such circumstances, we will use reasonable endeavours to minimise disruption and notify you as soon as practicable.
9. Intellectual Property
All content on our website and app — including text, graphics, logos, images, and software — is the property of DAK Logistics Ltd or our licensors and is protected by UK and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Data Protection and Privacy
Our use of your personal data is governed by our Privacy Policy, which complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using our Services, you consent to the collection and processing of your data as described therein.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer under UK law.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Material changes will be notified to active account holders by email. Continued use of our Services after changes constitutes acceptance of the revised Terms.
